1. Company details: Absolute Money NW Limited (company number 11147436) ('we' and 'us') is a company registered in England and Wales and our registered office is at 7-9 Macon Court Crewe CW1 6EA. We operate the website absolutemoney.co.uk ('Website').

3. These terms: In these terms and conditions, we explain our services, how the contract between you and us is formed and, when it comes to an end. There are other terms and conditions in addition to the ones set out in this document, that will apply to our contract with you. These include:

2. Our contract with you
1. Our services: We help our customers find a mortgage by using the details your provide to source the available deals from the whole of the market(‘Services’). We provide all types of mortgages. including purchasing your first home, moving home or refinancing your existing mortgage to raise equity.
2. Our contract: When accessing our Website and completing the online mortgage questionnaire, you are instructing us to provide the Services. Once you submit the questionnaire, you are entering into a legally binding contract with us ('Contract') that is made on and subject to these terms and conditions ('Terms'). Please note these Terms apply to our Contract with you, to exclusion of any other terms that you seek to impose or incorporate, or which are implied by law, trade custom, practice or course of dealing.
3. Entire agreement: The Contract is the entire agreement between you and us in relation to the Services. You acknowledge that you have not relied on any statement, promise or representation or assurance or warranty that is not set out in the Contract.
4. Your copy: You should print off a copy of these Terms or save them to your computer for future reference.
3. Our Services
1. How to request the Services from us: To instruct us to provide the Services to you, you must complete and submit the mortgage questionnaire on the Website. Simply follow the onscreen prompts to help you do this.
2. Correcting input errors: Our online questionnaire allows you to check and amend any errors before submitting your request to us. Please check your details carefully before confirming them. You are responsible for ensuring that the details you input into the questionnaire are complete and accurate.
3. Acknowledging receipt: After you submit the questionnaire, you will receive an email from us acknowledging that we have received your submission. You will receive a call from us to ensure we understand your requirements before we can recommend a product.
4. Reasonable care and skill: We agree to provide the Services as defined by the Financial Conduct Authority.
5. We are a mortgage broker: Please note that where we make any introductions to a lender, we are acting as your mortgage broker.
6. Performing our Contract: Once we have entered into a Contract with you and you have submitted the online questionnaire, we will add your details to our directory and conduct credit referencing checks. Provided those checks come back as acceptable, we will share your details with lender(s) who may be able to fulfil the mortgage request that you are making. Please note who we refer you to, very much depends on the details you submit as part of the questionnaire and the results of any credit referencing checks that we conduct.

1. Contact: We will contact you directly to discuss your mortgage requirements. You do not have to proceed with the mortgages we recommend, and are free to seek alternative advice.
5. Cancelling your request and termination
1. Cancelling your request: If after submitting the online questionnaire, you no longer want us to share your details with a lender or, make recommendations of mortgages to you, then please let us know by contacting us using the details set out in clause 1.2.
2. We can refuse to provide the Services: If we choose, we can refuse to provide the Services to you, decline your request to receive the Services or, cancel our Contract with you. If we do this, we will inform you in writing.
6. Your obligations
1. It is your responsibility to ensure that:
1. the information you provide to us is complete and accurate; and
2. you cooperate with us in all matters relating to the Services.
7. Intellectual property rights
1. All intellectual property rights in or arising out of or in connection with the Services and the Website are owned by us (or where applicable, our third party licensors). Nothing in the Contract shall transfer ownership of those rights to you.
8. Charges
1. We do not charge a fee to provide the Services to you.
9. How we may use your personal information
1. We will use any personal information you provide to us to:
1. provide the Services;
2. refer you to lenders(s);
3. inform you about similar services that we provide, but you may stop receiving these at any time by contacting us.
2. We will process your personal information in accordance with our privacy policy, the terms of which are incorporated into this Contract.
10. YOUR ATTENTION IS PARTICULARLY DRAWN TO THIS CLAUSE.
1. Nothing in the Contract limits any liability which cannot legally be limited, including liability for:
1. death or personal injury caused by negligence;
2. fraud or fraudulent misrepresentation; and
3. breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession).
2. Subject to clause 10.1, we will not be liable to you, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for any loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings loss of business opportunity, goodwill or reputation; indirect, special or consequential loss.
3. Subject to clause 10.1, our total liability to you arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, will be limited to £1,000.
4. As provided for above, you acknowledge that the contract for the provision of a mortgage or any related services is between you and the broker and as such, it is the broker who is responsible for the provision of those services to you. We shall have no liability to you whatsoever in respect of the provision of the services or your dealings with any of the brokers who are listed on the Website or contact you following our introduction.
5. This clause 10 will survive termination of the Contract.
11. Events outside our control
1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under the Contract that is caused by any act or event beyond our reasonable control (Event Outside Our Control).
2. If an Event Outside Our Control takes place that affects the performance of our obligations under the Contract:
1. we will contact you as soon as reasonably possible to notify you; and
2. our obligations under the Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. We will arrange a new date for performance of the Services with you after the Event Outside Our Control is over.
3. You may cancel the Contract affected by an Event Outside Our Control. To cancel please contact us.
12. Communications between us
1. When we refer to 'in writing' in these Terms, this includes email.
2. Any notice or other communication given by one of us to the other under or in connection with the Contract must be in writing and be delivered personally, sent by pre-paid first class post or other next working day delivery service, or email.
3. A notice or other communication is deemed to have been received:
1. if delivered personally, on signature of a delivery receipt;
2. if sent by pre-paid first class post or other next working day delivery service, at 9.00 am on the second working day after posting; or
3. if sent by email, at 9.00 am the next working day after transmission.
4. The provisions of this clause will not apply to the service of any proceedings or other documents in any legal action.
13. General
1. Assignment and transfer
1. We may assign or transfer our rights and obligations under the Contract to another entity.
2. You may only assign or transfer your rights or your obligations under the Contract to another person if we agree in writing.
2. Variation: We may amend these Terms from time to time. Any amendments made will be posted on our Website.
3. Survival: Any provision of the Contract that expressly or by implication is intended to come into or continue in force on or after termination will remain in full force and effect.
4. Waiver: If we do not insist that you perform any of your obligations under the Contract, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you or that you do not have to comply with those obligations. If we do waive any rights, we will only do so in writing, and that will not mean that we will automatically waive any right related to any later default by you.
5. Severance:Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them is unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
6. Third party rights: The Contract is between you and us. No other person has any rights to enforce any of its terms.
7. Governing law and jurisdiction: The Contract is governed by English law and we each irrevocably agree to submit all disputes arising out of or in connection with the Contract to the exclusive jurisdiction of the English courts.
